Terms of use
Effective date:
The short version
- The Star Battle is free. There is no account to make and nothing to buy, and you need neither to play.
- Play it, and share your results and links to it, as much as you like.
- Do not copy the puzzles in bulk, republish them, or use automated tools to collect them.
- Your progress lives in your own browser. If the browser’s data is cleared, it is gone, and we cannot bring it back.
- The site is offered as it is. We cannot promise it will always be available, and we are responsible only for loss we could have foreseen.
This summary is for convenience. The numbered sections below are the terms.
1. Who we are, and these terms
The Star Battle (thestarbattle.com) is one of the Quiet Arcade games and is operated by Andrei Kovalev (“we”, “us”). These terms are the agreement between you and us about your use of the site. By using it you accept them. If you do not accept them, please do not use the site.
How we handle information is set out in the privacy policy, and what the site stores on your device is set out in the cookie policy. Both apply alongside these terms.
If you are under the age at which you can accept terms like these where you live, please read them with a parent or guardian.
2. The service
The Star Battle is a free puzzle game. It has no accounts, no subscriptions and no purchases, and nothing on it is for sale.
A new daily puzzle starts at 00:00 UTC, and it is the same puzzle for every player. It can appear some time after that, while the site is updated.
Your progress, streaks, records and awards are stored in your browser on your device, not on our servers. They have no monetary value and cannot be sold or exchanged. If you clear your browser’s data, use private browsing or switch device, they will not follow you unless you move them yourself with a backup, where the site offers one. We have no copy from which to restore them.
We may change, pause or stop any part of the site at any time, including a puzzle, a feature or the site as a whole. Because the site is free and holds nothing you have paid for, we do not owe you notice or compensation when we do.
3. Using the site
You may use the site for your own personal, non-commercial enjoyment. You are welcome to share links to it and to share your own results, including any result text the game prepares for you to share.
You may not:
- access the site with automated tools such as bots, scrapers or crawlers, or request pages in bulk; general search engines that follow the site’s robots rules, and assistive technology you use to read or play, are welcome;
- copy, collect or download the puzzles or their solutions in bulk, including past daily puzzles, or build a collection or dataset of them;
- republish, sell or redistribute the puzzles or solutions, in print or online, or present the site or any part of it as your own;
- interfere with the site or its hosting, try to get around any of its limits or security, or put more load on it than ordinary play does;
- use the site in any way that breaks the law or harms anyone else.
If you would like to use the puzzles in a way these terms do not allow, for example in a publication or a classroom, write to us at support@mixiebar.com and ask.
4. Who owns what
The puzzles on The Star Battle are generated by us with our own software, and checked before they are published. The puzzle type itself belongs to nobody. The site, its code, text, design and graphics belong to us or are used with permission, and the puzzles and our collection of them are ours to the extent the law protects them. These terms do not transfer any of those rights to you; they only give you the permission to use the site that section 3 describes.
Some parts of the site are made by others and used under open licences, which continue to apply to them. They include the interface icons (Material Symbols, by Google, under the Apache License 2.0). The copyright and licence notices for them are in NOTICE.txt.
5. Other sites and services
The site links to other websites, including our other games, and a result you share goes wherever you choose to send it. We do not run those sites or apps and are not responsible for them; their own terms apply once you use them.
The site also depends on services run by others, such as its hosting provider. Which services handle information about you, and when, is set out in the privacy and cookie policies.
6. Not affiliated
The Star Battle is not affiliated with, endorsed by, or connected to LinkedIn, Microsoft, or The New York Times. Star Battle is a puzzle format, played in print for decades and implemented independently here.
7. No warranty
The site is provided “as is” and “as available”. As far as the law allows, we make no promise that it will be available at any particular time, free of errors, or suited to any particular purpose, and no promise that your progress will be kept.
8. Limits on our liability
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable. Because your progress, streaks and awards are stored only in your browser and we hold no copy, we cannot restore them if they are lost, and they have no monetary value.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, such as liability for death or personal injury caused by negligence, or for fraud. Nothing in them takes away any right you have as a consumer under the law of the country where you live that cannot be waived by agreement.
9. Law and courts
These terms are governed by the law of Cyprus. If you use the site as a consumer, you also keep the protection of the mandatory rules of the law of the country where you live. You may bring proceedings in the courts of Cyprus or of the country where you live, and we may bring proceedings against you only in the courts of the country where you live.
10. Changes to these terms
We may update these terms, for example when the site changes or the law does. The current version is always on this page, with the date it took effect at the top. If a change matters to how you use the site, we will also say so on the site before it takes effect. If you do not agree with a change, you can stop using the site. Changes do not apply to anything that happened before they took effect.
11. General
If a court finds any part of these terms invalid, the rest continue to apply. If we do not enforce a term straight away, we have not given up the right to enforce it later.
12. Contact
For anything about these terms, write to Andrei Kovalev at support@mixiebar.com.
